Rental Policy
These Rental Terms and Conditions (the "Terms and Conditions") set forth the policies, rules, and regulations that apply to your rental (“Rental”) of costumes, accessories, or other wardrobe related items (“Costumes”) from Carmine & Hayworth. These Terms and Conditions are made part of the C & H Rental Form (the “Rental Form”) and shall apply to all Rentals thereunder and any additional documentation required for your Rental. Any reference to these Terms and Conditions shall be deemed to include the Rental form and any other documentation as applicable. All terms and conditions proposed by you which are different from or in addition to these Terms and Conditions and are deemed to be material alterations and shall not be binding upon Carmine & Hayworth unless agreed in writing by Carmine and Hayworth. Please note that all costumes rented from Carmine & Hayworth will be used for the purpose of stated event, photoshoots or Theater/Film and for no other use.
24 Hour Approval Period
C&H offers a 48 Hour Approval Period for fitting purposes only. Garments used for any other purpose during the Approval Period will be charged as a Weekly Rental. Costumes returned within the 48 Approval Period are subject to a 20% restocking fee. WHEN CUSTOMER PULLS THEIR OWN ORDER, THEY MUST RENT AT LEAST 50% OF THE ORDER.
Rental Period
Weekly Rental (8 calendar days) All rental items kept past the 8-day period will be automatically charged the Production Rental Rate. Production Rental (9 days to 8 weeks) The Production Rental Rate is full Production Rental Rate. (see your Rental Form for each items Production Rental Rate) All items kept past the initial 8-week period will be automatically charged 30% of Production Rental Rate per a week. All rates shall be set forth on the Rental Form.
HOLDS
No items may be placed on hold before your account has been set up and verified with our accounting department. Rentals may be placed on hold 8 days prior to pick up date and any hold item that is not rented will incur a 30% restocking fee. Rentals placed on hold after 8 days will incur a charge of 5% of the Production Rental Rate per week for each week.
PAYMENT METHODS
All Rentals require a valid credit card on file and payment of a deposit as set forth in the Rental Form. All Rentals must be paid within thirty (30) days of the date of invoice. All unpaid amounts owed after such thirty (30) day period shall be subject to a service charge of 1.5% per month or, if less, the maximum rate allowed by law. Final invoices may be paid in cash, by approved company check, Visa, Mastercard or American Express. No checks are accepted. C & H reserves the right to charge the credit card on file for any overdue invoices plus any applicable service charge.
ALTERATIONS
Alterations are never allowed without written permission from C & H. Iron-on bonding web, glue, super stick or any other type of permanent adhesives may NOT be used. Failure to return garments in their original condition will incur damage or replacement charges.
CLEANING FEE
Cleaning Fees are included in Rental Cost. A cleaning fee equal to 15% of the rental amount total is charged on all rentals brought back in soiled condition.
RESTOCKING
All items pulled but not rented must be restocked at the time of the pull. There will be a 20% restock fee if not restocked properly.
RETURN PROCEDURES
Costumes are to be returned with all hangers, bags, boxes or other items that were sent with the Rental.
DAMAGED OR LOST GARMENTS
In the event of loss, theft or damage of any Costume, (normal wear and tear excluded) Customer shall be responsible for payment of the repair or replacement. Full replacement value equals 10 times the Rental price, unless otherwise specified by C & H on the Rental Form. Damage includes but is not limited to broken zippers, detached garment pieces, make-up or other permanent stains or any other damage that renders the costume unfit for rental. Damages to costumes which cannot be reasonably repaired at the discretion of C & H will be assessed at the replacement value of the costume. Such damages include, but are not limited to irreparable tears, major seam damage, damage from pins, or irreversible damage. If damage has occurred to a Costume, please contact C & H. Early/Late Open charges will apply when customers request these services. Fittings may be scheduled by appointment only.
CHOICE OF LAW; VENUE
These Terms and Conditions and any dispute related to the Rental shall be governed by the laws of the State of North Dakota. The choice of venue for all disputes shall be Cass County, Fargo, North Dakota. I understand and acknowledge that the Rental Form/Invoice is subject to the Terms and Conditions and includes any other documentation required for Rental, including but not limited to the Production Information Form, Credit Card Authorization Form or Credit Application and Qualified Vendor Form.
